Program Overview

Who Should Attend

If you are interested in learning about the big picture of divorce/separation/parentage process this course if for you. This course is will also help you decide whether you should hire a full time lawyer to represent you or choose from the many other options available to you such as hiring a lawyer to represent you on a limited-scope basis or representing yourself.

Why You Should Attend

Like all things in life, things become simpler once you know what you are doing. The Divorce process is no different. It is much simpler once you know what you are doing. How do you know what you are doing?You educate yourself. By educating yourself you empower yourself to make the right choices.

This course is not meant to teach you the entire divorce/separation/parentage process. It is an overview of the legal process aimed at familiarizing you with the big picture of the divorce/separation/parentage process.

What You Will Learn

Learn the 1-2-3’s of the Divorce, Separation and Parentage process. Please refer to the course agenda for a detailed breakdown of the material that will be covered in this online course.

Part One: We start by giving you a technical overview of the divorce process in California. This includes introducing you to procedural divorce law as well as substantive divorce law. Procedural law is the procedures you have to follow to navigate your case from inception to its end. In other words, it is a roadmap you need to use to go about getting what you want. For example if you want child support, you must file a form FL-300 and FL-115 and follow the filing and service rules set forth by the code of civil procedure. Substantive law is the actual law which provides each spouse or parent with a set of rights. Both procedural law and substantive law are very important in a divorce case.

Part Two: We will introduce you to the rules of evidence and your right to discovery. You will see examples of how important it is to provide the Court with competent evidence it can properly take into consideration in making its decision. Furthermore, we will discuss the tools available to you to demand information and documents from your spouse or other parent in a process called discovery. One of the most important parts of your family law case is telling your story to the judge. There is an art and science to telling your story. In part 2, you will learn about the skill of storytelling in a courtroom environment and an overview of the rules of evidence.

Part Three: Next, we introduce you to the many different legal help options which are available to you so you can choose the right legal help for your budget. We will discuss how to choose the right lawyer (how to understand their retainer agreement), hiring a lawyer for a limited-scope purpose for a set fee, mediation, arbitration, collaborative divorce and handling your case yourself without an attorney (in pro per). Once you understand the big picture of divorce, you will be in a better position to decide for yourself to what degree you want to involve a lawyer.

Tuition: Tuition for this program is $195. For government employees, we offer a special rate of $150.

Cancellation and Substitution: Free cancellation available 5 days prior to the date of program. You may substitute another person at any time. We will refund tuition, less a $50 cancellation fee, if we receive your cancellation by 5:00 p.m. the day prior to program. After that time, we will credit your tuition toward attendance at another
program.
